They Hate That It Cuts Them Out."},"content":{"rendered":"<p>Every broker who&#8217;s ever told you subject-to or wraps are &#8220;too risky&#8221; is protecting something \u2014 but it isn&#8217;t you. The real reason your broker hates creative finance isn&#8217;t liability. It&#8217;s that you make money on those deals and they don&#8217;t.<\/p>\n<p>Let me show you the math on that.<\/p>\n<h2>The Traditional Broker Model, Stripped Bare<\/h2>\n<p>A traditional brokerage runs on one revenue stream: the commission split. You close a $300k deal, the seller pays 3%, you split it with your broker \u2014 they take 30%, 40%, sometimes more if you&#8217;re newer. That&#8217;s how their lights stay on. That&#8217;s the machine.<\/p>\n<p>Now here&#8217;s where it breaks.<\/p>\n<p>You find a tired landlord. He&#8217;s got a 3.5% mortgage from 2021. He doesn&#8217;t need cash \u2014 he needs out. You structure a subject-to deal: you take over his loan payments, he deeds you the property, you rent it or sell it on a wrap to a new buyer.<\/p>\n<p>Your broker sees zero of that transaction.<\/p>\n<p>No listing commission. No buy-side commission. Nothing to split. And if you wholesale it, they&#8217;re completely invisible \u2014 you found the deal, you found the buyer, and your assignment fee bypasses the MLS, the listing agreement, and their hand entirely.<\/p>\n<p>That&#8217;s why the conversation always ends with &#8220;I&#8217;m not comfortable with the liability.&#8221; It&#8217;s not about TREC. It&#8217;s not about E&amp;O. It&#8217;s about the fact that they built a machine that only works when every deal runs through them.<\/p>\n<h2>The Liability Excuse, Decoded<\/h2>\n<p>Here&#8217;s what they&#8217;ll say: &#8220;Subject-to puts us at risk. The due-on-sale clause could trigger. The buyer might not carry insurance. The lender could call the note.&#8221;<\/p>\n<p>All technically true. None of it is why they won&#8217;t support you.<\/p>\n<p>Brokers process transactions every day with real liability exposure \u2014 representing both sides in competitive offers, submitting lowballs on distressed properties, navigating HOA litigation in active lawsuits. They manage that exposure fine. They have E&amp;O for a reason.<\/p>\n<p>The difference is those transactions pay them. Subject-to doesn&#8217;t. So the liability they&#8217;re suddenly &#8220;worried about&#8221; is magically unmanageable on the deals where they make nothing.<\/p>\n<p>What they&#8217;re protecting isn&#8217;t their E&amp;O policy. It&#8217;s their split.<\/p>\n<h2>When They&#8217;re Actually Right<\/h2>\n<p>Here&#8217;s where I&#8217;m going to be honest with you, because this is the part that makes the rest land: some brokers restrict creative finance because they genuinely don&#8217;t know how to supervise it. That&#8217;s a real limitation \u2014 not because the deals are inherently dangerous, but because a broker who&#8217;s never processed one cannot guide you when something goes sideways.<\/p>\n<p>A subject-to deal has moving parts. You&#8217;re taking over a loan without triggering the due-on-sale clause, which means the seller has to genuinely understand the risk they&#8217;re retaining \u2014 that conversation needs to happen clearly, documented, on paper. A wrap mortgage means knowing how to structure the interest spread using a TREC contract and how to handle the underlying note if the seller needs to exit later.<\/p>\n<p>If your broker has never done one of these deals, they can&#8217;t supervise you doing one. That is a legitimate gap \u2014 not a legal opinion, a capability one. The &#8220;no&#8221; they&#8217;re handing you is honest. It&#8217;s just incomplete. The rest of that sentence is: <em>&#8220;&#8230;and I don&#8217;t know anyone who does.&#8221;<\/em><\/p>\n<p>That&#8217;s a broker problem. Not a deal problem.<\/p>\n<h2>What Happens When Inventory Sits<\/h2>\n<p>We&#8217;re in a market right now where DOM is climbing. Sellers who listed in January are still sitting in July, anchored to a price nobody&#8217;s paying.<\/p>\n<p>That&#8217;s when creative finance stops being &#8220;alternative&#8221; and becomes the most logical offer in the room.<\/p>\n<p>Here&#8217;s the play: seller&#8217;s anchored to $95k. Your all-cash number is $52k. Instead of walking, you offer $80k seller-financed \u2014 $450\/month, 10-year note. Most sellers say no. But you&#8217;re working two variables \u2014 price and terms \u2014 instead of one. The deals that pencil on seller financing when straight cash won&#8217;t work? Those stack up and cash flow for years after the market has moved on.<\/p>\n<p>One of our agents locked a 10-year note on a non-standard property that multiple lenders passed on. Every &#8220;no&#8221; just meant finding the right yes. The deal closed. The property cash flows. The conventional brokers who said the deal structure was &#8220;too complex&#8221; are still running comps on houses that look exactly like all the other houses.<\/p>\n<p>Your broker can&#8217;t help you build deals like that. They&#8217;re not trained for it, they&#8217;re not set up for it, and honestly \u2014 they&#8217;re not incentivized to be. They built a business where the agent is a production unit and the commission is the product.
